DELAWARE COUNTY COMMISSIONERS SPECIAL MEETING
January 23, 2009
The Board of County Commissioners of Delaware County, Oklahoma, met in Special Session on January 23, 2009 at 10:05 A.M and recessed at 12:00 PM. Agenda was posted January 20, 2009 at 1:15 P.M. on east entrance door and the south west entrance.
Members of the Board present were Chairman-Billy Cornell, Commissioner Dave Kendrick-Member. Commissioner Ken Crowder -Member and Secretary Carol Fortner were absent. The Board of Delaware County Commissioners are hereby authorized to take action on the following items:
AGENDA #1-A motion was made by Commissioner Kendrick and seconded by Commissioner Cornell to approve of the agenda as posted. Roll call: Commissioner Cornell -yes, Commissioner Kendrick-yes. Motion carried.
AGENDA #2-A motion was made by Commissioner Kendrick and seconded by Commissioner Cornell to go into Executive Session pursuant to Title 25 Oklahoma Statutes Sec. 307 (B)(4) Confidential communications between a public body and its attorney concerning a pending investigation, claim or action if the public body with the advice of its attorney determines that disclosure will seriously impair the ability of the public body to process the claim or conduct a pending investigation, litigation or proceeding in the public interest: To meet with the District Attorney, Co. Sheriff and Judges as well as other necessary parties, to discuss means of mitigating Delaware County’s liability in case #CH-2006-213 (State of Oklahoma, ex rel., Protective Health Services, the Oklahoma State Dept. of Health vs Board of Commissioners of Delaware County and Jay Blackfox – Sheriff of Delaware County). Roll call: Commissioner Cornell -yes, Commissioner Kendrick-yes. Motion carried.
AGENDA #3-A motion was made by Commissioner Kendrick and seconded by Commissioner Cornell to return to regular session with possible action to mitigate Delaware County’s liability in case #CH-2006-213. The following action was taken: Possibility to run a County Survey in news papers for the Public to select what prisoners to release and DA office to contact Dept. of Health with this plan. Roll Call: Commissioner Cornell-Yes, Commissioner Kendrick-Yes. Motion Carried.
AGENDA #4- A motion was made by Commissioner Kendrick and seconded by Commissioner Cornell to adjourn meeting. Roll call: Commissioner Cornell-yes, Commissioner Kendrick-yes. Motion carried.
