DELAWARE COUNTY COMMISSIONERS MEETING

September 22, 2008

The Board of County Commissioners of Delaware County, Oklahoma, met in Regular Session on September 22, 2008 at  9:00 A.M.   Agenda was posted September 18, 2008 at 4:30 P.M. on east entrance door.  This meeting was recessed at 3:30 PM .  

 

Members of the Board present were Chairman-Ken Crowder, Commissioner Billy Cornell-Member and Commissioner  Dave Kendrick-Member.  The Board of Delaware County Commissioners are hereby authorized to take action on the following items:

 

AGENDA #1-A motion was made by Commissioner Kendrick and seconded by Commissioner Cornell to approve of the agenda as posted.   Roll call: Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes. Motion carried.

AGENDA #5-A motion was made by Commissioner Crowder and seconded by Commissioner Kendrick to receive/file/discuss any reports from engineers for Delaware County road/bridge projects.  Tim McCrary  gave updates on bridge/road projects.  Roll call: Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes. Motion carried.

 

AGENDA #6-A motion was made by Commissioner Kendrick and seconded by Commissioner Cornell to approve Notice of Hearing on petition for Annexation of territory to the West Jay rural water district #1 of Delaware Co.  The proposed property is located in sections as follows: 20, 21, 22, 27, 28, 29, 32, 33 & 34 of twp. 23 North, rng. 23 East and sections 14, 15, 16, 19, 20, 21, 22, 23, 27, 28, 229, 30 of twp. 22 North, Rng. 23 East all in Delaware Co.  This annexation is due to such lands are without adequate water supply.  Hearing has been set for October 6, 2008 at 9:00AM.  Roll call:  Commissioner Kendrick-yes, Commissioner Crowder-yes, Commissioner Cornell-yes.  Motion carried.

 

AGENDA #7-A motion was made by Commissioner Kendrick and seconded by Commissioner Cornell to approve signing of 324A claim to ODOT for engineering services to Rose & McCrary, PC on project #CR-212C(119) & CR-121D(120). Location (E510) from S710 Rd. West in Sections 22& 27and (E575) from Moseley Sch. West in sections 21, 22, 27, 28 twp. 20N, Rng. 25E.  Roll call: Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell- yes. Motion carried.

 

AGENDA #8-A motion was made by Commissioner Crowder and seconded by Commissioner Kendrick to approve creating new cash account known as “Bradshaw Bridge (S690) for Dist. 1 Commissioner Ken Crowder.   Roll call:  Commissioner  Crowder-yes, Commissioner Kendrick-yes,  Commissioner Cornell-yes.  Motion carried.

 

AGENDA #9-A motion was made by Commissioner Kendrick and seconded by Commissioner Cornell to reject all bids submitted on lease purchase of equipment for Dist. #3 Commissioner Dave Kendrick.  All bids were handed back to representatives un-opened and sealed.   Roll Call:  Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes.  Motion carried.

 

 

 

 

AGENDA #10-A motion was made by Commissioner Cornell and seconded by Commissioner Kendrick to reject all bids submitted on lease purchase of equipment for Dist. #2 Commissioner Bill Cornell.  All bids have been handed back and returned to representatives un-opened and sealed.  Roll Call:  Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes.  Motion carried.

 

AGENDA #11-The motion in regards with the re-advertisement for sealed bids on the lease equipment for Dist. #2 was not needed at this time.  No action was taken.  Roll Call:  Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes.  Motion carried.

 

AGENDA #12-A motion was made by Commissioner Kendrick and seconded by Commissioner Cornell to open and review all bids submitted on labor to erect salt sheds for Dist. #1 & 3 Commissioners for possible action.  Only one (1) bid was received from Paul Hight for a total of $20,000.00 for labor to erect salt sheds in Delaware Co.  The bid from Paul Hight Construction was accepted.  Roll Call:  Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes.  Motion carried.

 

AGENDA #13-A motion was made by Commissioner Kendrick and seconded by Commissioner Cornell to open and review all bids submitted on materials to erect salt sheds for Dist. #1 & 3 Commissioners.  The following bids were received: Vanover Metal Bldgs.-$11,500.00; Square One Truss-$11,200.00; Wheeler Metals, Inc.-$18,864.40; Sanco Lumber-$11,064.37.  Acceptance of lowest or best bid was set for one week on September 29th, 2008 in the Delaware Co. Commissioner’s meeting at 9:00 AM.  Roll Call: Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes.  Motion carried.

 

AGENDA #14-A motion was made by Commissioner Cornell and seconded by Commissioner Kendrick to receive update on information for  storm shelter program from Leroy Allen.  Roll Call: Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes.  Motion carried.

 

AGENDA #15-A motion was made by Commissioner Crowder and seconded by Commissioner Kendrick to approve entering into lease purchase agreement with ODOT and Dist. #1 Commissioner for equipment.  Roll Call: Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes.  Motion carried.

 

AGENDA #16-A motion was made by Commissioner Kendrick and seconded by Commissioner Cornell to review phone quotes on the replacement of roof at the Community Center Jay, OK.  Quotes received are as follows: Jeremy Husong-declined to bid; Allied Roofing-$84,442.76; BRB Roofing-declined to bid.  There was only one (1) bid received from Allied Roofing and that bid was accepted to tear down old roofing, dispose of and replace Community Center Roof.  Roll Call: Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes. Amended Journal Entry to follow.   Motion carried.

 

AGENDA #17-A motion was made by Commissioner Kendrick and seconded by Commissioner Cornell to approve bid from Jr. Vickery on property not sold at Land Sale located in Flint Ridge #4-Walnut Hill, Lot 196, Blk. 16 and  Flint Ridge #4 Walnut Hill, Lot 91, Blk. 16 in the amount of $150.00.  Roll Call: Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes.  Motion carried.

 

AGENDA #18-A motion was made by Commissioner Cornell and seconded by Commissioner Kendrick to approve designation of officers for the Delaware Co. OSU Extension Center.  Roll Call: Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes.  Motion carried.

 

AGENDA #19-A motion was made by Commissioner Kendrick and seconded by Commissioner Cornell to approve pledge of support in the amount of $850.00 to the County Clerk’s office from the Tiff City Fire Dept.   Roll Call: Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes.  Motion carried.

 

AGENDA #20-A motion was made by Commissioner Crowder and seconded by Commissioner Kendrick to approve of lease of land between the City of Bernice and District #1 Commissioner to place salt sheds on City property located in Sec. 23, Twp. 25, Rng. 22 for a period of twenty (20) years with one year terms commencing on the 1st day of October 2008.  Roll Call: Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes.  Motion carried.

 

AGENDA #21-A motion was made by Commissioner Kendrick and seconded by Commissioner Cornell to go into Executive session pursuant to Title 25 Oklahoma Statutes, sec. 307 (B) (4) for the purpose of confidential communications between the Board of Commissioners and its attorney concerning Federal Lawsuits, Shelby Haggard, charging  party vs. Delaware Co. Sheriff’s Dept. respondent, Equal Employment Opportunity Commission #564-2008-1590 and Joey J. Lambert, charging party vs. Delaware Co. Sheriff’s Dept., respondent, equal employment opportunity commission #564-2008-1591.  Roll Call: Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes.  Motion carried.

 

AGENDA #22-A motion was made by Commissioner Kendrick and seconded by Commissioner Crowder to return to regular session.  No action was taken at this time. Roll Call: Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes.  Motion carried.

 

AGENDA #23-A motion was made by Commissioner Crowder and seconded by Commissioner Kendrick to create a new cash account known as “Seneca Cayuga Road” for Dist. #1.  The Seneca Cayuga Road Dept. will release to Delaware Co. Dist. #1 the full amount funds to be utilized on the Seneca Cayuga Tribal Grounds Road project in the amount of $2,070,877.10.   Roll Call: Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes.  Motion carried.

 

AGENDA #24-A motion was made by Commissioner Kendrick and seconded by Commissioner Crowder to meet with the representatives from Health Choice Insurance Co. to discuss insurance policy/benefits offered by Delaware Co. for  employees.  Roll Call: Commissioner Crowder-yes, Commissioner Kendrick-yes, Commissioner Cornell-yes.  Motion carried.
