DELAWARE COUNTY COMMISSIONERS

SPECIAL MEETING

August 14, 2008

The Board of County Commissioners of Delaware County, Oklahoma, met in Special Session on August 14, 2008 at 9:00 A.M. Agenda was posted August 11, 2008 at 3:05 P.M. on east entrance door.  This meeting was recessed at 10:15 A.M.

Members of the Board present were Commissioner Ken Crowder-Chairman, Commissioner Dave Kendrick-Member .  Commissioner Billy Cornell-Member was absent and Co. Clerk-Carol Fortner was absent.   Board of Delaware County Commissioners is hereby authorized to take action on the following items:

AGENDA #1-Motion was made by Commissioner Kendrick and seconded by Commissioner Crowder to approve agenda as posted. Roll Call: Commissioner Kendrick-yes, Commissioner Crowder-yes.  Motion carried.

AGENDA #2-Motion was made by Commissioner Kendrick and seconded by Commissioner Crowder to go into Executive Session concerning pending  State of Oklahoma vs Delaware County Board of Commissioners, Oklahoma State Dept. of Health case # CH-2006-213 pursuant to title 25 sec. 307 B(4) Oklahoma Statutes.  District Atty. Eddie Wyant, ADA Nick Lelecas and Sheriff Jay Blackfox were in attendance.  Roll Call: Commissioner Kendrick-yes, Commissioner Crowder-yes.  Motion carried.

AGENDA #3-Motion was made by Commissioner Kendrick and seconded by Commissioner Crowder to return to regular session with the following action to be taken concerning the pending state of Oklahoma  vs  Delaware Co. Board of Commissioners, Oklahoma State Dept. of Health case #CH-2006-213 pursuant to title 25 sec. 307 (B) (4).  Authority has been granted to Dist. Atty. Wyant to enter into settlement negotiations with regards to the overcrowding issue in the Delaware Co. Jail facility upon dismissal of remaining allegations in the AOC (Administrative Order of Compliance) order filed as of  09-12-06.  The county retains the right to argue the monetary punishment before the Administrative Law Judge at a later date.   Roll Call: Commissioner Kendrick-yes, Commissioner Crowder-yes.  Motion carried.

AGENDA #4-Motion was made by Commissioner Kendrick and seconded by Commissioner Crowder to adjourn Special Meeting.   Roll Call: Commissioner Kendrick-yes, Commissioner Crowder-yes.  Motion carried.

There being no further business to discuss, the meeting was recessed.
